DEA code for ‘marijuana extracts’ not to affect Medical Marijuana Inc’s hemp oil products

As many have seen, the media has been filled with the recent news from the US Drug Enforcement Administration. The DEA’s “Establishment of a New Drug Code for Marijuana Extract” lists new rules for those working with CBD & extracts within the cannabis industry.

However, the media has been misreporting the story quite often. Some of the misinformation includes such outrageous headlines like “New DEA Rule Says That CBD Is Illegal“.

In a statement made on 12/16/16, Medical Marijuana, Inc. CEO, Dr. Stuart Titus said: “[We] are pleased to announce that the DEA Federal Registry amendment to create a new code for ‘marijuana extracts,’ in no way affects the Company’s hemp oil.” This contains naturally occurring cannabinoids, including CBD, or its operations.

The Ninth Circuit Court of Appeals upheld that hemp products are legal for import from Europe. Included are those marketed by the Company because the products derive from plant parts exempt from the Controlled Substances Act

The Ninth Circuit case served to uphold the legality of the Company’s products. During the case, the Court struck rules that had been promulgated by the DEA. The rules would have made the Company’s products a scheduled substance. However, the Court permanently enjoined the DEA from enforcing the stricken rules.

There has been no superseding ruling since the Ninth Circuit’s decision. Therefore, the Company’s products continue to be legal and are not controlled substances. Accordingly, the legality of Medical Marijuana, Inc.’s products remains unchanged in light of this new Federal Registry.
